Photographs and Video
Please be aware that the event will be filmed and pictures will be taken by the members of the New Brighton Association Board and/or designated volunteers. The photographs and video may be used for promotional purposes, in print and/or online.
Toilets
As the event is only a couple of hours, please be aware that toilets will not be available at the event.
First Aid
A first aid kit will be available at the jury table should it be required. Please take the appropriate precautions if your child has any allergies that may impact their ability to be involved in any activity
Garbage and Recycling
The public garbage and recycling bins will be available in the vicinity of the event. Please help us keep the area clean and tidy, while also doing our part for the community by recycling where applicable.
Participant or Spectator
We want all children and families to have a wonderful afternoon, either participating or watching. Your responsible involvement will help us to make this a fabulous event and one we can grow and build on each year. Please follow all the physical distancing rules as per AHS and Province requirements.
CLAIM WAIVER AND RELEASE FROM LIABILITY FORM
In consideration for the opportunity to participate in activities or events at Bike Parade event, I hereby assume all the risks of participating or volunteering, including by way of example and not limitation, any risks that may arise from negligence or carelessness (including gross and malicious negligence) on the part of the persons and entities being released, from dangerous or defective equipment or property owned, maintained or controlled by them or because of their possible liability without fault.
I certify that I and my child are physically fit, have sufficient prepare or trained for the activity/activities we choose to participate, and have not been advised to avoid the physical activity involved by a medical professional. I further certify that there are no health-related reasons or problems that preclude our participation in the activities or event in which I choose to engage.
I acknowledge that this Claim Waiver and Release from Liability Form will be used by others, including but not necessarily limited to the event holders, sponsors and organizers of the activity or event in which I may participate, and that it will govern my actions and responsibilities in connection with such activity or event.
(A) I WAIVE, RELEASE AND DISCHARGE from any and all liability, including but not limited to, liability arising from the gross and careless negligence or fault of the entities or person released, for my death, disability, personal injury, property damage, property theft, or actions of any kind which may hereafter occur to me including my traveling to and from this activity or event, THE FOLLOWING ENTITIES OR PERSONS: New Brighton Community Association, and/or their members directors, officers, volunteers, representatives, and agents, the activity or event holders, activity or event sponsors, activity or event volunteers;
(B) I HOLD HARMLESS, AND PROMISE NOT TO SUE the entities or persons mentioned in the immediately preceding paragraph from any and all liabilities or claims made as a result of my participation and my child’s participation in this activity or event, whether caused by the gross and careless negligence of release or otherwise. I further agree to indemnify, defend and hold harmless the entities or persons mentioned in the immediately preceding from any claims asserted by my family members or any other persons who accompany me or with whom I am associated even if those claims arise out of gross and reckless negligence of the released parties or otherwise.
I acknowledge that the activities or events in which I participate may involve a test of a person’s physical and mental limits and may carry the potential for death, serious injury, and property loss. The risks may include but are not limited to, those caused by terrain, facilities, temperature, weather, condition of participants’ equipment, lack of hydration, and the actions of other people including, but not limited to, participants, volunteers, spectators, event officials, and event monitors, and/or producers of the event. These risks are not only inherent to participants, but are also present for volunteers.
I hereby consent to receive medical treatment which may be deemed advisable in the event of injury, accident and/or illness during this activity or event.
I understand that while engaging in the event my family and I may be photographed. I agree to allow our photo, video, or film likeness to be used for any purpose, without compensation, by the entities and persons set forth in pargraph (A) above.
The claim waiver and release of liability shall be construed broadly to provide a release and waiver to the maximum extent possible under applicable law.
I recognize that this claim waiver and release of liability applies to all activities and at the Bike Parade event whether formally organized or simply a part of casual recreation activity. I further recognize that this claim waiver and release will remain in effect from the date of my signing forward, unless formally revoked by me in writing transmitted to and actually received by one of the Officers of the New Brighton Community Association.
I CERTIFY THAT I HAVE READ THIS DOCUMENT, AND I FULLY UNDERSTAND ITS CONTENT. I AM AWARE THAT THIS IS A RELEASE OF LIABILITY AND A CONTRACT AND BY WRITING MY NAME IN THE REGISTRATION FORM I SIGN IT OF MY OWN FREE WILL.
PARENT / GUARDIN WAIVER FOR MINORS (Under 18 years old)
The undersigned parent and natural guardian does hereby represent that he/she is, in fact, acting in such capacity has consented to his/her child or ward’s participation in the activity or event, and has agreed individually and on behalf of the child or ward, to the terms of the accident waiver and released liability set forth above. The undersigned parent or guardian further agrees to save and hold harmless and indemnify each and all of the parties referred to above from all liability, loss, cost, claim, or damage whatsoever which may be imposed upon said parties because of any defect in or lack of such capacity to so act and release said parties on behalf of the minor and the parents or legal guardian.
